Progressive Voters Guide’s graphics, logos, designs, page headers, button icons, scripts and service names are trademarks or trade dress of Progressive Voters Guide in the U.S. and/or other countries.  Nothing in these terms grants you a right or license to use any trademark, design right or copyright owned or controlled by Progress Virginia or any third party, except as expressly provided in these Terms.

User Conduct

You understand and agree that the Website is available for your personal, non-commercial use only. You further agree not to harvest or collect email addresses or other contact information of Users from the Website by electronic or other means.  Additionally, you agree not to use automated scripts to collect information from the Website or for any other purpose.  You further agree that you may not use the Website in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Website. Governing Law; Venue and Jurisdiction

By visiting or using the Website, you agree that the laws of the State of Virginia, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that may arise between you and Progress Virginia.  Any action to enforce the terms of these Terms of Use, or arising out of the subject matter of these Terms of Use, shall be commenced in the state and/or federal courts of Seattle, Virginia, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and improper forum with respect to, venue and jurisdiction in the state and/or federal courts of Seattle, Virginia.

Indemnity

You agree to indemnify and hold Progress Virginia, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Website, your conduct in connection with the Website or with other Users of the Website, or any violation of this Agreement or of any law or the rights of any third party.

Other

These Terms of Use constitute the entire agreement between you and Progress Virginia regarding the use of the Website, superseding any prior agreements between you and Progressive Voters Guide relating to your use of the Website. The failure of Progressive Voters Guide to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision in that or any other instance. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. If any provision of these Website Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
